立契約書人x x x(以下簡(jiǎn)稱甲方),x x x(以下簡(jiǎn)稱乙方),茲因合作興建房屋事宜,經(jīng)雙方協(xié)議,同意訂定各條款如下:
第一條 甲方所有坐落x x x x地號(hào)土地一筆,如附圖所示,約x x平方米。愿提供與乙方合作興建房屋。
第二條 本約甲方所提供的土地雙方協(xié)議同意興建四層鋼筋混凝土造和集合住宅,除依法應(yīng)設(shè)置的公私道路用地外,其余可建土地,乙方應(yīng)依法合理充分利用。
第三條 本約雙方合作興建房屋,其土地規(guī)劃,建筑設(shè)計(jì),請(qǐng)領(lǐng)建造執(zhí)照,營(yíng)造施工及有關(guān)的風(fēng)險(xiǎn)等,均由乙方負(fù)責(zé)處理并負(fù)完全責(zé)任,其各類費(fèi)用亦由乙方負(fù)擔(dān),概與甲方無涉。乙方營(yíng)造施工過程中,甲方得隨時(shí)親自派員監(jiān)督。
第四條 本約甲乙雙方按附圖所示的擬建房屋為準(zhǔn),采立體分屋方式,由甲方取得百分之x x ,乙方取得百分之x x 。若雙方分取的房屋戶數(shù)未能整數(shù)時(shí),其間的差額,可經(jīng)雙方的同意,由取得之一方按協(xié)議價(jià)格以現(xiàn)金補(bǔ)償對(duì)方。
第五條 本約有關(guān)建造設(shè)計(jì)文件圖說應(yīng)征求甲方同意,并按前條雙方分配的位置,標(biāo)明于圖說上,各自具名或指定第三人為起造人,由乙方負(fù)責(zé)提出申請(qǐng)建造執(zhí)照。
第六條 本約興建房屋事宜,均依現(xiàn)行建筑法規(guī)辦理,若法規(guī)變更而受限制時(shí),則依變更后的法規(guī)辦理。
第七條 凡畸零地及水利地的合并承買等事宜,均由甲方備齊所需證件并由乙方負(fù)責(zé)辦理。惟
